“Ada satu surah di dalam Al Quran yang terdiri dari tiga puluh ayat yang akan mensyafa’ati kepada pembacanya itu, sehinggalah ia diampunkan. Ini adalah surah Tabarakal-ladhi”

Rites of Hajj – The Sight of Kaa’ba

Just a quick reminder to all of us before my continuation. May Allah guide us and give us wisdom.

The Sight of Kaa’ba

One never tires of gazing at the sight of the House of Allah, the Kaa’ba. The site upon which the mercy and blessings of Allah are constantly descending. There is truly nothing comparable to the House of Allah on this Earth. People wish time would stand still so they could keep gazing at the Kaa’ba; their thirst is never quenched, rather it increases.

Once, while on a visit to Washington, people told me that a woman had accepted Islam and had some questions for me. They told me that many non-practicing Muslim women had started practicing again due to her. At prayer time she would dress in her best clothes as if readying herself for someone special, and would become oblivious to everything around her as soon she started praying.

After a brief question and answer session, I asked her what prompted her to accept Islam. She sighed and started explaining; “I was a Jew and my husband was a Christian who was posted in Saudi Arabia for some technical work. Everyday I used to see Muslim men and women dressed in white on their way somewhere. I asked my husband where they were going and he told me that they go to perform pilgrimage at the Muslim shrine of Kaa’ba. I expressed a desire to go but he told me that non-Muslims were not allowed. However, I was determined and so we both bought white clothes and set out. Fortunately no one stopped us and we reached Makkah, from where we found directions to the Kaa’ba. Upon seeing the Kaa’ba our eyes froze and time seemed to stand still. When we turned to look at each other after some time, we were both crying. With our eyes we told each other that this was the Truth and we should accept Islam. No one ever told me about Islam, but there were so many blessings descending on that House that they changed my life forever.”

The blessings of Tawhid descend in Makkah, and the blessings of Prophethood descend in Madinah. One has seen nothing in life if he has not seen these two holy sites. May Allah give all Muslims the opportunity to visit to His House.

Rites of Hajj

Assalamualaykum to all brothers and sisters, my apology to the long pause in my writing regarding the rites of hajj.

One of the requirement to perform hajj as a muslim should know is the one has to be able. This include the responsibilities towards the family members and dependant that you will leave behind. Ensuring the family will be able to have basic comfort and assistance in case of emergency. Leaving list of contacts to the person responsible looking after the family who is looking after your family is vital.

The Islamic Wills prior to hajj.

It is advisable for us to make a living/Islamic wills prior to your trip to hajj.

When a Muslim dies there are four duties which need to be performed. These are:

1. payment of funeral expenses 2. payment of his/her debts 3. execution his/her will 4. distribution of the remaining estate amongst the heirs according to Sharia law.

An islamic will is a transaction which comes into operation after the testator’s death. The will is executed after payment of funeral expenses and any outstanding debts.

The one who makes a will (wasiyya) is called a testator (al-musi).

The one on whose behalf a will is made is generally referred to as a legatee or testatee (al-musa lahu). – penerima wasiat.

The one who execute the will is called ‘The executor of the will ‘ (Al-wasi Al- mukhtar)

The importance of the Islamic will

“It is the duty of a Muslim who has anything to bequest not to let two nights pass without writing a will about it.” (Sahih al-Bukhari)

“A man may do good deeds for seventy years but if he acts unjustly when he leaves his last testament, the wickedness of his deed will be sealed upon him, and he will enter the Fire. If, (on the other hand), a man acts wickedly for seventy years but is just in his last will and testament, the goodness of his deed will be sealed upon him, and he will enter the Garden.” (Ahmad and Ibn Majah)

The islamic will gives the testator an opportunity to help someone (e.g. a relative need such as an orphaned grandchild ) who is not entitled to inherit from him. The will can be used to clarify the nature of joint accounts, those living in commensality, appointment of guardian for one’s children and so on.

In countries where the intestate succession law is different from Islamic law it becomes absolutely necessary to write a will.

The Islamic Will

The Islamic will includes both bequests and legacies, instructions and admonishments, and assignments of rights.

No specific wording is necessary for making a will. In Islamic law the will (wasiyya) can be oral or written, and the intention of the testator must be clear that the wasiyya is to be executed after his death. Nowadays, a written will is better and should have two male witness to it.

The Testator (Al-musi)

Every adult Muslim with reasoning ability has the legal capacity to make a will. An adult for this purpose is someone who has reached puberty.

In  Islamic law the power of the testator is limited in two ways:

Firstly, he cannot bequest more than 1/3 of his net estate unless the other heirs consent to the bequest or there are no legal heirs at all or the only legal heir is the spouse who gets his/her legal share and the residue can be bequeathed.

Narrated Sa‘d ibn Abi Waqqas (RA): “I was stricken by an ailment that led me to the verge of death. The Prophet came to pay me a visit. I said, “O Allah’s Apostle! I have much property and no heir except my single daughter. Shall I give two-thirds of my property in charity?” He said, “No.” I said, “Half of it?” He said, “No.” I said, “One-third of it?” He said, “You may do so, though one-third is also too much, for it is better for you to leave your offspring wealthy than to leave them poor, asking others for help…” (Sahih al-Bukhari, Sahah Muslim, Muwatta, Tirmidhi, Abu Dawud and Ibn Majah.)

2ndly, the testator cannot make a bequest in favour of a legal heir. However, some Islamic countries do allow a bequest in favour of a legal heir providing the bequest does not exceed the bequeathable one-third. Legal heir in this context is one who is a legal heir at the time of death of the testator.

Narrated Abu Hurayrah (RA): Allah’s Prophet (SAWS) said, “Allah has appointed for everyone who has a right what is due to him, and no bequest must be made to an heir. (Abu Dawud). Similar hadith narrated by Abu Umamah (RA) and reported by Ibn Majah, Ahmad and others.

The Legatee (Al-musa lahu) – penerima wasiat

Generally speaking, for a bequest to be valid, a legatee must be in existence at the time of death of the testator.

Acceptance or rejection of a bequest by the legatee is only relevant after the death of the testator and not before. Generally speaking once a legatee has accepted or rejected a bequest he cannot change his mind subsequently.

Executor of the will (Al-wasi Al- mukhtar)

The executor (al-wasi) of the will is the manager of the estate appointed by the testator. The executor has to carry out the wishes of the testator according to Islamic law, to watch the interests of the children and of the estate. The authority of the executor should be specified. The executor should be trustworthy and truthful and must be just.

Perkongsian Hadith 15

Sekadar berkongsi peringatan dengan sahabat sekampung.

 
عَنْ أَبِي هُرَیْرَةَ رَضِىَ الله عَنْهُ أَنَّ رَسُوْلَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّم قَالَ: (( مَنْ آَانَ یُؤْمِ نُ
 بِاللهِ وَاليَوْمِ الآخِرِ فَلْيَقُلْ خَيْرًا أَوْ لِيَصْمُتْ، وَمَنْ آَانَ یُؤْمِنُ بِاللهِ وَاليَوْمِ الآخِرِ فَلْيُكْرِمْ جَارَهُ، وَمَنْ آَانَ یُؤْمِنُ بِاللهِ واليَوْمِ الآخِرِ فَلْيُكْرِمْ ضَيْفَهُ )) رواه البخاري ومسلم

Dari Abu Hurairah radhiyallahu anhu, sesungguhnya Rasulullah Shallallahu ‘alaihi wa Sallam telah bersabda : “Barang siapa yang beriman kepada Allah dan hari akhirat, maka hendaklah ia berkata baik atau diam, barang siapa yang beriman kepada Allah dan hari akhirat, maka hendaklah ia memuliakan tetangga dan barang siapa yang beriman kepada Allah dan hari akhirat, maka hendaklah ia memuliakan tamunya”.

[Bukhari no. 5672, Muslim no. 47]

 Nilaian Hadith

  • Hadith membicarakan soal adab yang dititikberatkan  dalam Islam.
  • Keutamaan adab  sangat tinggi  nilainya di sisi Islam terutama bagi seorang yang benar-benar beriman.

Syarahan Hadith

 

  1. 1.     Berkata baik atau diam

 

  • Seorang yang beriman perlu berhati-hati dalam pertuturan kerana sebagaimana firman Allah dalam surah Qaf; ayat 18 :

 

“Tidak ada satu perkataan yang diucapkan melainkan ada  di sisinya malaikat pengawas yang sentiasa siap mencatat.”

 

  • Menurut Imam Syafie, makna hadith ini bahawa apabila seorang hendak berkata hendaklah ia befikir. Bila ternyata tiada bahaya atasnya, berkatalah. Tetapi bila ternyata sebalikya, maka diamlah.
  • Rasulullah saw menegah diam yang tercela iaitu;
    • Diam dari menyatakan yang hak
    • Diam dari menegur yang salah
    • Sebagai muslim yang mencari redha-Nya, perlulah sentiasa bermuhasabah diri kerana apabila banyak bercakap, maka banyaklah hitungannya. Tanpa sedar, kata-kata kita mungkin menyakitkan hati orang lain.
    • Seseorang yang tidak berhati-hati bila berkata-kata mengundang lebih banyak penyesalan dan mungkin pula menyebabkan dosa.
    • Justeru, banyakkan zikir kerana 90% dari kesejahteraan itu terdapat pada diam kecuali waktu zikir pada Allah.

 

  1. 2.     Muliakan jiran dan tetamu

 

  • Jiran adalah;
    • Orang yang tinggal serumah
    • Orang yang berdekatan rumah dengan kita
    • Orang yang tinggal dalam lingkungan jarak 40 buah rumah dari segala penjuru
    • Orang yang tinggal senegeri dengan kita
  • Mengetahui tiga jenis hak jiran;
    • Jiran musyrik yang mempunyai satu hak, iaitu hak jiran
    • Jiran muslim yang mempunyai dua hak, iaitu hak jiran dan hak Muslim
    • Jiran kerabat Muslim yang mempunyai tiga hak, iaitu hak Islam, hak jiran dan hak kerabat
  • Seorang yang beriman tidak akan membiarkan dirinya kenyang sedangkan jirannnya lapar. Rasulullah saw turut menggalakkan supaya melebihkan kuah apabila memasak lauk supaya dapat diberikan kepada jiran.
  • Jiran hendaklah mencegah menggunakan sesuatu (barang, tempat dan sebagainya) yang menjadi miliknya sendiri untuk faedahnya tetapi membahayakan dan menyusahkan jirannya.
  • Memuliakan tetamu adalah budi pekerti Nabi Muhammad saw iaitu dengan melakukan kebaikan kepadanya sebagai orang yang dating.
  • Melayani tetamu dengan cara yang sopan sesuai dengan keadaannya serta memberikan jamuan menurut kadar yang dapat disediakan; selama sekurang-kurangnya sehari semalam dan tiga hari, sebanyak-banyaknya. Jika lebih maka menjadi sedekah ke atas tuan rumah.
  • Jikalau tetamu mengetahu bahawa tuan rumah adalah dari orang yang sempit kehidupannya sehingga jamuan itu dating dari makanan mereka dan anak-anak mereka, tiada halal bagi seseorang itu mendiami sehingga menyusahkannya.

 

Kesimpulan

 

Hadith ini menunjukkan bahwa antara tuntuan iman adalah berkata yang baik atau diam, memuliakan jiran, sekurang-kurangnya tidak menyusahkannya dan juga memuliakan serta meraikan tetamu.

Tuntutan ini jika disempurnakan maka meningkat iman dan kesuburan nya. Kalau tidak, maka berkuranglah ia  serta hapuslah pula satu cabang dari cabang-cabang iman

Tips Rites of Hajj.

Alhamdulillah, I have recently completed the Fifth Arkan of Islam, the Hajj with my beloved wife. May Allah accept our Hajj. Just want to share some tips and the do’s and dont’s pre hajj and during the rites of Hajj itself.

I will start with the booking process for the trip for Hajj. In Ireland, the Manasik Tour www.gohajj.ie is one of the agent that handle the jamaah for the rites of Hajj. They will need your passport, your translated marriage certificate – if you are going with your wife (you can do this in Dublin Mosque if you have not done so) and a copy of your GNIB card if you are not an Irish passport holder. They normally ask all this a few weeks before the departure date. However, payment is made around June to July.
